HealthLink Insights, LLC (TechLink Health, "we, or "us") operates under the brand names HealthLink Insights and TechLink Health.  TechLink Health's primary goal is making healthcare practitioners more accessible to ultimately provide the best patient outcomes, which in turn means that we are committed to protecting your privacy and we take great care with your personal information that we gather when you access or use TechLink.Health and related websites, applications, and services owned and operated by TechLink Health (the "Platform") and that link to this Privacy Policy (collectively, the “Services”). This Privacy Policy is meant to assist consumers and businesses that use our Services to access provider expertise or schedule appointments and providers and other health entities that use our services understand how we manage your personal information. 

Agreement to Privacy Policy

By accessing and using the website and mobile application you are subject to and in agreement with this Privacy Policy and Terms of Service. By using the Platform, you expressly agree to the terms of this Privacy Policy and consent to the collection and use of information.

If you do not agree with this Privacy Policy, please do not use or access the Platform for any purpose. Please print a copy of this Privacy Policy for your records.

Changes to This Privacy Policy

TechLink Health may revise the Privacy Policy at our discretion and at any time. When we make changes to the Privacy Policy, we will notify you by email or through a notice on our website homepage. Use of the information we collect is subject to the Privacy Policy in effect at the time such information is collected.

Collection, Use and Disclosure of Information

 

TechLink Health or a third party vendor on behalf of TechLink Health may automatically collect information while using the Platform. We may collect such information by tracking, or asking a third party vendor to track, your click-stream activity when such information is not tied to a user ID through the use of "cookie" technology or by tracking internet protocol (IP) addresses.

Because we want our Platform to better serve users, we collect some basic and typical information about users and their devices.  This information is used to continuously enhance our Platform and to better serve our users' needs.

The Information collected from users of the Platform may be shared with our suppliers and vendors and used in the aggregate to create analysis to for technical trouble shooting, developing product enhancements, performance analysis, and other applicable use cases, such as:

  • To provide and maintain our Service.

  • To notify you about changes to our Service. 

  • To allow you to participate in interactive features of our Service when you choose to do so.

  • To provide customer support.

  • To gather analysis or valuable information so that we can improve our Service.

  • To monitor the usage of our Service.

  • To detect, prevent and address technical issues.

  • To provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information.

By continuing to use the Platform, you hereby consent to the use and disclosure of your Information as set forth in this agreement.  We seek to protect your Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of Personal Data and how we are processing that data. We endeavor to follow generally accepted industry standards to protect the Personal Data submitted to us, both during transmission and in storage.  We store and process your information on servers in the United States and abroad. 

Usage Data

 

When you access the Service with a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data ("Usage Data").

Location Data

 

We may use and store information about your location if you give us permission to do so ("Location Data"). We use this data to provide features of our Service, to improve and customize our Service. You can enable or disable location services when you use our Service at any time by way of your device settings.

HIPAA and Personal Health Information

 

Certain demographic, health and/or health-related information that TechLink Health collects about Consumers as part of providing the Services to our Clients may be considered “protected health information” or “PHI” under the Health Insurance Portability and Accountability Act (“HIPAA”). Specifically, when TechLink Health, acting as a “Business Associate” (as such term is defined in HIPAA) receives identifiable information about a Consumer from or on behalf of a Client, or Customer’s doctor, dentist, or other healthcare specialist, professional, provider, organization or agent or affiliate thereof (collectively, “Healthcare Providers”), this information is considered PHI. Personal data that a Consumer provides to TechLink Health outside of the foregoing context is not PHI. For example, when you provide information directly to us, such as when creating an account or using our interactive tools and services, searching for Healthcare Providers or available appointments with Healthcare Providers, and completing medical history forms (“Medical History Forms”); or when you voluntarily provide information in free-form text boxes through the Services or through responses to surveys and questionnaires, or post reviews; or when you send us an email or otherwise contact us, that information is not PHI.

HIPAA provides specific protections for the privacy and security of PHI and restricts how PHI is used and disclosed. TechLink Health may only use and disclose PHI in the ways permitted by a Consumer’s Healthcare Provider(s) or authorized by a Consumer.

Use of Cookies

 

Like many companies, we use "cookies" to help you better navigate the Platform. A "cookie" is a small piece of information sent by TechLink Health's web-based applications that are stored by your web browser on your computer's hard drive. Cookies enhance your online experience by saving your preferences while you are visiting a particular Website. The cookies do not contain any identifiable information and cannot profile your system or collect information from your hard drive. Most Internet browsers automatically accept cookies, but you can set your browser to refuse them or to alert you when they are being sent.

Legal Basis for Processing Personal Data under the General Data
Protection Regulation (GDPR)

 

If you are from the European Economic Area (EEA), TechLink Health legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it. TechLink Health may process your Personal Data because:

 

  • We need to perform a contract with you.

  • You have given us permission to do so.

  • The processing is in our legitimate interests and it is not overridden by your rights.

  • For payment processing purposes.

  • To comply with the law.

Please note that we may ask you to verify your identity before responding to such requests.
 

You have the right to complain to a Data Protection Authority about our collection and use of your Personal Data. For more information, please contact your local data protection authority in the European Economic Area (EEA).

Business Transaction

If TechLink Health is involved in a merger, acquisition or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.

Legal Inquiries

Under certain circumstances, TechLink Health may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government
agency).


TechLink Health may disclose your Personal Data in the good faith belief that such action is necessary to:

  • To comply with a legal obligation.

  • To protect and defend the rights or property of TechLink Health.

  • To prevent or investigate possible wrongdoing in connection with the Service.

  • To protect the personal safety of users of the Service or the public.

  • To protect against legal liability.

Retention of Data and Security

TechLink Health will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.


TechLink Health will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer periods.

TechLink Health seeks to protect your Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of Personal Data and how we are processing that data. We endeavor to follow generally accepted industry standards to protect the Personal Data submitted to us, both during transmission and in storage.

TechLink Health stores and processes your information on servers in the United States and abroad. We maintain what we consider industry standard backup and archival systems. You should also help protect your data by appropriately selecting and protecting your password and/or other sign-on mechanism; limiting access to your computer or device and browser; and signing off after you have finished accessing your account. Although we work to protect the security of your account and other data that we hold in our records, please be aware that no method of transmitting data over the Internet or storing data is completely secure. We cannot and do not guarantee the complete security of any data you share with us, and except as expressly required by law, we are not responsible for the theft, destruction, loss or inadvertent disclosure of your information or content.

Controlling Your Personal Information

 

You have a right to request that TechLink Health amend or delete the Personal Information it collects from your use of the Platform if you believe it is incorrect or incomplete, and you may request an amendment or deletion for as long as the Personal Information is retained. You must submit your request in writing to TechLink Health and provide a reason to support the requested amendment. TechLink Health may, under certain circumstances, deny your request by sending you a written notice of denial.

Subject to applicable law, you may withdraw your consent to uses and disclosures of Personal Information as outlined in this Privacy Policy. You must submit your request in writing to TechLink Health. Withdrawing consent does not invalidate consent to any collection, use or disclosure of Personal Information to which you consented before consent was withdrawn. If you withdraw consent, or refuse further consent, TechLink Health's ability to offer services to you may be limited.

California Resident Rights

 

The California Consumer Privacy Act of 2018 (“CCPA”) provides California residents with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Information Collected

Through your use of our Platform, we may collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Visitor ("personal information"). The only personal information that our websites have collected from Visitors and used or disclosed for business purposes during the last twelve (12) months is IP Address and information that Visitors have directly provided to us through the Platform such as through our testimonial page or when seeking additional information. 

Personal information does not include:

  • Publicly available information from government records.

  • Deidentified or aggregated consumer information.

  • Information excluded from the CCPA's scope, like:

  • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data (which means if you are a member of TechLink Health and you log into the secure portion of our website, this Policy does not apply to the information collected or used on the secure portals);

  • Personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.

TechLink Health obtains the categories of personal information listed above from the following categories of sources:

  • Information you submit on the contact information on the Website.

  • Indirectly by collecting IP Address in order to observe your actions on our Websites.

Use of Personal Information

 

TechLink Health does not sell and has not sold any Personal Information in the preceding twelve (12) months.  We may use or disclose the personal information we collect for business or marketing efforts such as managing the Platform, enhancing performance of the Platform, direct marketing of services, responding to legal inquiries, or Platform support.  TechLink Health will not collect or use additional personal information without providing you notice.

Disclosure of Personal Information

TechLink Health may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

We share the minimum necessary personal information with service providers that provide audit, legal, operational, technical or other services for us, such as monitoring website activity, reporting and analytics, marketing and advertising, data aggregators.

Right to Request Access to Information

You have the right to request certain information about our collection and use of your Personal Data over the past 12 months, including the following:

  • The categories of Personal Data that we have collected about you.

  • The categories of sources from which that Personal Data was collected.

  • The business or commercial purpose for collecting or selling your Personal Data.

  • The categories of third parties with whom we have shared your Personal Data.

  • The specific pieces of Personal Data that we have collected about you.

If we have disclosed your Personal Data for a business purpose over the past 12 months, we will identify the categories of Personal Data shared with each category of third-party recipient.

If we have sold your Personal Data over the past 12 months, we will identify the categories of Personal Data purchased by each category of third-party recipient.

Right to Request Deletion of Information

You have the right to request that we delete the Personal Data that we have collected from you. Under the CCPA, this right is subject to certain exceptions: for example, we may need to retain your Personal Data to provide you with the Services or complete a transaction or other action you have requested. If your deletion request is subject to one of these exceptions, we may deny your deletion request.

Exercising Your Rights

To exercise the rights listed above, please submit a request in writing to TechLink Health via the contact information listed in the Contact Information section.

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a request related to your personal information. You may also make a request on behalf of your minor child.

You may only make a request for access twice within a 12-month period. Your request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a request does not require you to create an account with us.

We will only use personal information provided in a request to verify your identity or authority to make the request.

We will respond to a request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

For Requests to Access, our response will only cover the 12-month period preceding the request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. We will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without issue.

We do not charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising your rights under the CCPA. We will not deny you our goods or services, charge you different prices or rates, or provide you a lower quality of goods and services if you exercise your rights under the CCPA. However, we may offer different tiers of our Services as allowed by applicable data privacy laws (including the CCPA) with varying prices, rates, or levels of quality of the goods or services you receive related to the value of Personal Data that we receive from you.

Other California Privacy Rights

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Data to third parties for such third parties’ direct marketing purposes; in order to submit such a request, please contact us at connect@techlink.health.

Changes to This Privacy Policy

We reserve the right to amend our Privacy Policy at our discretion and at any time. When we make changes to the Privacy Policy, we will notify you by email or through a notice on our website homepage. Use of the information we collect is subject to the Privacy Policy in effect at the time such information is collected.
